Professional Biography of Tracey Dwyer

Tracey’s journey in the legal industry commenced in 2005 as a legal assistant to a Partner of a small boutique firm in the Sydney CBD.

After completing a conveyancing course early in her career, Tracey completed a Certificate V in Business Services (Legal) and became a Senior Paralegal in the areas of Wills & Estates and Conveyancing, then went on to work for firms of various sizes throughout her career, providing her with a unique skillset and substantial insight into the industry.

Guidance Law provides services specifically in the area of Wills & Estates and Property to ensure you receive a high level of expertise every time you engage our services.
Wills
It is a legal document that outlines your wishes regarding the appointment of an executor and distribution of your estate (i.e. your assets such as your house, car, bank account, etc, and your liabilities.) after your passing. There are complex laws which govern the construction of Wills. You should always seek legal advice when making your Will to ensure the terms of your Will are valid and operable.
Power of Attorney
A power of attorney is a legal document in which you appoint a trusted individual, known as your attorney, to make financial and legal decisions on your behalf. It is important to seek legal advice to ensure your power of attorney is structured to assist with preventing elder abuse if you lose capacity.
Appointment of Enduring Guardian
An appointment of enduring guardian is a legal document where you appoint a trusted individual, known as your guardian, to make health and lifestyle decisions on your behalf. An enduring guardian document ensures your wishes are followed if you are no longer able to make these decisions for yourself. This appointment becomes particularly important when you need someone to liaise on your behalf with Centrelink, My Aged Care and healthcare providers to ensure you receive the assistance you need.
Probate
Probate is the process of the Executor of a Will proving to the Supreme Court that the Will they hold is the original and most recent Will of the deceased, it meets legal formalities and that they are entitled to administer the deceased’s Estate. Applications for Probate are a legal process which require proper advice and guidance to ensure the Executor meets its legal obligations in administration of the Estate.
Conveyancing
Conveyancing is not only the transfer of real estate ownership from one party to the other, but also involves a multitude of other transactions such as registration of caveats, mortgages, leases and other dealings on title which may affect the proprietor’s freedom to deal with the property. It is a complex area of law where the smallest mistakes can lead to significant consequences.
